TERMS & CONDITIONS

Libbys Patch Farm Seasonal Events, Pick Your Own & Christmas Tree Sales

Welcome to Libbys Patch Farm! We are a family-run farm, and we love welcoming visitors to enjoy our seasonal activities, farm produce and festive experiences.

To help everyone enjoy their visit safely and fairly, please read the following Terms & Conditions before making a booking or purchase.

By booking an event, purchasing a ticket or visiting our farm, you agree to these Terms & Conditions.

1. Bookings & Payments

Some activities and events require advance booking and payment.
All bookings are subject to availability and are only confirmed once payment has been received.
Please check your booking confirmation carefully to ensure your selected date, time and number of tickets are correct.
Tickets are valid only for the date and time specified on your booking confirmation, unless otherwise agreed by the farm.
Tickets must not be resold or transferred for commercial purposes without our prior permission.

2. Customer Cancellations & Non-Attendance

If you are unable to attend a booked event, please contact us as soon as possible.
Tickets are generally non-refundable if you cancel your booking, fail to attend or arrive after your allocated time slot.
We may, at our discretion, offer an alternative date, booking transfer or gift card where circumstances allow.
We reserve the right to consider exceptional circumstances on a case-by-case basis.

These terms do not affect any cancellation or refund rights you may have under applicable consumer law.

3. Event Cancellations, Severe Weather & Acts of God

As a working farm, many of our activities take place outdoors and are dependent on weather conditions, crop availability and factors outside our reasonable control.

Events may occasionally need to be cancelled, postponed, amended or closed at short notice due to circumstances including, but not limited to:

Severe weather, storms, flooding, high winds, snow or ice.
Extreme temperatures or unsafe ground conditions.
Crop failure, poor growing conditions or damage to crops.
Fire, natural disasters, disease outbreaks or other emergencies.
Government restrictions, public safety concerns or other circumstances beyond our reasonable control.

Where an event is cancelled by the farm due to an act of God or circumstances beyond our reasonable control, our policy is to offer affected customers a gift card to the value of their eligible booking, rather than a monetary refund, wherever legally permitted.

Gift cards may be used towards eligible future events, activities or purchases at Libbys Patch Farm, subject to the terms stated on the gift card.

We will notify affected customers as soon as reasonably possible and provide details of how to receive and redeem their gift card.

We will always endeavour to operate events as advertised. However, we cannot guarantee that weather, crops or other natural conditions will remain suitable throughout the season.

Nothing in this section excludes or limits any rights or remedies that cannot legally be excluded under applicable consumer law.

4. Pumpkin Picking, Strawberry Picking & Sunflower Picking

Our pick-your-own activities are seasonal and depend on natural growing conditions.

Crop availability, quantity, size, colour and quality may vary throughout the season.
We cannot guarantee that every variety or crop will be available on your chosen date.
Picking areas may be restricted or closed where crops are unavailable or conditions are unsafe.
Picking fees, entry tickets and produce charges will be explained at the time of booking or purchase.
Please follow all signs and staff instructions regarding where and how to pick produce.
Picking produce outside designated areas, damaging plants or taking produce without payment is not permitted.
Produce must be paid for in accordance with the pricing and payment arrangements displayed on site.

Where a particular crop is unavailable, we will explain any available alternatives or options in accordance with the advertised booking terms and applicable consumer law.

5. Christmas Tree Sales

Christmas trees are natural products, and each tree will vary in shape, size, colour and appearance.

Tree sizes are approximate unless a specific measurement is expressly guaranteed.
Availability is subject to stock levels, and particular varieties or sizes cannot be guaranteed unless confirmed at the time of purchase.
Customers are encouraged to inspect their chosen tree before purchase.
Care instructions may be provided to help customers maintain their tree after purchase.
Once a tree has been cut, collected or delivered, any concerns about its condition should be reported to us as soon as reasonably possible.
Our returns, replacements and refund arrangements will be handled in accordance with applicable consumer law. Nothing in these terms removes your statutory rights if a product is faulty, not as described or otherwise fails to meet legal requirements.

6. Children & Supervision

Children must be supervised by a responsible adult at all times.
Parents and guardians are responsible for the behaviour, safety and welfare of the children in their care.
Children must follow farm safety instructions and remain within designated visitor areas.
Some activities or areas may have age restrictions or additional safety requirements.
The farm accepts no responsibility for children left unsupervised.

7. Farm Safety & Visitor Conduct

A farm is a working environment, and certain areas may contain uneven ground, machinery, animals, vehicles or other hazards.

All visitors must:

Follow all safety signs, instructions and directions given by farm staff.
Remain within designated visitor areas.
Avoid entering restricted areas or approaching machinery and farm equipment.
Wear appropriate footwear and clothing for outdoor conditions.
Behave respectfully towards staff, other visitors, crops, animals and farm property.

We reserve the right to refuse entry or ask visitors to leave if their behaviour presents a safety risk, causes disruption or breaches these Terms & Conditions. Any refund entitlement will be determined in accordance with applicable law and the circumstances.

8. Dogs & Other Animals

Dogs and other animals are permitted only where expressly stated in the event information or farm signage.

Where dogs are permitted, they must be kept under control and on a lead unless otherwise instructed. Owners are responsible for cleaning up after their animals.

Assistance dogs will be accommodated in accordance with applicable legal requirements and reasonable safety arrangements.

9. Parking & Personal Belongings

Parking arrangements will be communicated on arrival or in your booking information.
Vehicles are parked at the owners risk, subject to applicable law.
Visitors are responsible for their personal belongings throughout their visit.
Please do not leave valuables unattended in vehicles or around the farm.

10. Accessibility & Special Requirements

We want our farm to be as welcoming as possible. However, as a working farm, some areas may have uneven surfaces, grass paths, mud, slopes or other access limitations.

If you have accessibility requirements or need assistance, please contact us before your visit so we can explain the facilities available and discuss reasonable adjustments where appropriate.

11. Photography & Social Media

Visitors are welcome to take photographs for personal use, provided they respect the privacy of other visitors and follow any photography restrictions communicated by the farm.

We may take photographs or videos for promotional purposes only where we have an appropriate lawful basis to do so. Where consent is required, we will obtain it.

Please speak to a member of staff if you have any concerns about promotional photography.

12. Liability

We take reasonable steps to maintain a safe environment for our visitors. However, visitors must take reasonable care of their own safety and follow all farm instructions.

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we are not responsible for losses arising from circumstances beyond our reasonable control, except where applicable law provides otherwise.

13. Changes to Events & Opening Hours

Seasonal events depend on weather, crop conditions, staffing, safety and other operational factors.

We reserve the right to make reasonable changes to event arrangements, opening hours, facilities or activities where necessary. Where a change materially affects a booking, we will communicate with affected customers and provide any remedy required by applicable law.

Please check our website or social media pages for the latest opening hours, event updates and seasonal information before travelling.

14. Gift Cards

Unless otherwise stated in writing:

Gift cards are redeemable against eligible goods, activities or events offered by Libbys Patch Farm.
Gift cards are not redeemable for cash, except where required by law.
Lost or stolen gift cards should be reported to us as soon as possible.
Gift cards are subject to their stated expiry date and redemption conditions, which will be provided at the time of issue.
Gift cards issued following event cancellations will be subject to the specific terms communicated when they are issued.

Nothing in these terms removes any statutory rights relating to gift cards or the underlying booking.
